Driving a Motor Vehicle not in accordance with a Driving Licence. Section 87 Road Traffic Act 988.

Another complicated little offence. It sounds far simpler than it is.

This offence if convicted carries just a fines and costs in some circumstances, in other circumstances it carries 3-6 penalty points (or a discretionary ban), a fine and costs.

The court decides whether the driving licence offence carries points or not dependant on whether you have an entitlement to drive.

A simple analysis would be;

Never passed a test, licence revoked under the new drivers act,  or driving without L plates/supervision/glasses (if you are required to where them by your licence) results in 3-6 points or a discretionary ban.

Test passed and your licence revoked for failing to sending it in for points to be added, or the dvla have suspended your licence because you need to change your address etc should not result in points.

Be careful. The court and the Crown prosecution Service will often get this wrong. The wording in Schedule 2 Road Traffic Offenders Act 1988 is complex and easily misunderstood.

The police will also often suggest that a revoked licence invalidates your insurance. This is normally an incorrect assumption and you should speak to us before accepting a no insurance offence.
